This Digital Banking Privacy Notice, hereafter referred to as “Privacy Notice”, explains how we collect, protect, use and share your data when you access and use any of the Agribank digital platforms such as online banking and mobile app (hereinafter, “Agribank Online”).

Agribank is committed to fully protect your personal data privacy in compliance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (DPA). When you access or use any of Agribank’s digital platforms, you consent to the collection, use, processing and disclosure of your information in accordance with our Privacy Statement.

What we may collect from you

To use Agribank Online, you may need to provide or utilize some of your personal data. This is necessary for verifying your identity, logging into your Agribank Online account, and authenticating your transactions.

We gather both personal and non-personal data when you use Agribank Online. This includes information you voluntarily provide to us such as:

1. Your name and personal particulars such as contact details and birthdate for identity verification.

2. Your account information and details such as card number, customer number or loan account number.

3. Your Agribank Online username, password, PIN Code, biometrics or other authentication credentials.

4. Other information you may provide when you contact us

We automatically collect information when you use and access Agribank Online:

1. Online banking and other transactions executed through Agribank Online including its partner website and applications known as open banking

2. IP address of your device or computer

3. Device identifier for the device running Agribank’s mobile application

4. Personal and non-personal information combined

5. Web browser type

We may gather non-personal information, aggregated and anonymized data about your use of Agribank Online, including:

1. Data and time you visited the site

2. The pages and internal links accessed on our site

3. Non-personal information about Agribank’s banking products, service and other transactions

4. Information and files that have been downloaded to the Agribank Mobile app

5. The type of operating system you have

6. Your internet service or mobile telecommunications provider

7. Your device location or geolocation

How we use your information

We utilize the personal data collected through Agribank Online for the following purposes:

1. Identification and Authorization: To verify your log-in to your online banking account, authenticate transactions, and process applications.

2. Enhanced User Experience: Recognizing you or your device when launching the app for a more secure and personalized experience

3. Request Handling: Responding to and processing your requests efficiently.

4. Customization and Improvement: Enhancing and customizing other online services based on your information.

5. Fraud and Crime Prevention, Detection, Security and Prosecution: Using your data to prevent, detect, and prosecute fraudulent activities.

Agribank strictly uses personal data only for the intended purposes for which it was collected, as well as any other purposes to which you may have given consent.

How we share your information

The Client understands that installing third-party remote access apps, screen recorders, or messaging apps capable of sharing screen or device access may compromise account security. The Bank shall not be held liable for any loss resulting from the Client’s installation or use of such applications.

We may disclose your personal data to our subsidiaries, affiliates, or other third party partners and vendors, subject to strict confidentiality obligations. This sharing is done for the following purposes:

1. Service Provision: To assist in providing you with the requested products and services.

2. Transaction Facilitation: To facilitate or implement transaction-related services.

3. Analytics and Enhancement: To analyze the use of our features and functionalities and identify areas for improvement.

4. Risk Mitigation: To protect our clients and business from fraudulent and illegal activities

How we protect your information

The Client is responsible for maintaining the security of their devices, networks, and access credentials. The Bank shall not be liable for any unauthorized access or disclosure resulting from the Client’s failure to secure their device or login information.

The privacy and security of your personal data are of utmost importance to us. Accordingly, we implement a comprehensive range of safety measures and safeguards across digital, operational, and physical domains. These measures ensure the confidentiality, integrity, and availability of your personal data. Our employees receive rigorous training on the proper handling and care of personal data. Additionally, we hold our third-party partners and vendors to the same high security standards to protect personal data effectively.

How do we store your information

We securely store files containing personal information on our computers and servers. Additionally, we may utilize cloud-based third-party data storage providers for storing your personal information. Rest assured that we take necessary precautions to safeguard your data.

How long do we keep your information

We will retain your information for as long as necessary to fulfill the purposes for which it was collected, and in accordance with applicable laws and regulations. In compliance with the Data Privacy Act, the Anti-Money Laundering Act, BSP regulations, and the National Internal Revenue Code, the Bank shall retain customer records for at least five (5) years from the date of the last transaction or account closure, or longer where required for regulatory reporting, audit, investigation, or legal proceedings. Thereafter, the information shall be securely deleted or anonymized, unless continued retention is required by law.

How do we dispose of your information

Physical records undergo secure disposal through shredding, while digital files are anonymized. In all cases, our disposal methods guarantee that personal information is no longer accessible or processed by unauthorized individuals.

What are your rights

In accordance with your privacy rights, you have the option to inform us of the following:

1. Marketing Preferences. You can choose not to receive marketing-related updates via email, SMS, or phone calls.

2. Access to Information. You may request information that we currently hold about you. Please note that certain legal and regulatory restrictions apply to us as a bank and a company operating in the Philippines.

3. Updating your Information. If there are any changes or updates to your personal details, you can inform us.

In compliance with the Anti-Financial Account Scamming Act (RA 12010) and BSP regulations, Agribank implements fraud management systems to monitor and detect suspicious transactions. We may temporarily hold disputed funds for verification, and share account information with the Bangko Sentral ng Pilipinas or law enforcement when required by law. Your personal data is processed securely, in accordance with the Data Privacy Act of 2012, and is retained only as necessary to protect you against scams. You have the right to report suspicious activity, request verification, and seek recovery of funds in case of fraud.

Changes to the Privacy Notice

Agribank maintains the right to update or modify this privacy notice as needed. Whenever significant changes occur, a new privacy notice will be issued. Additionally, the bank retains prior versions of the privacy notice and can provide them to data subjects upon request.
